This thesis deals in detail with the economic analysis of energy law from the perspective of sanctions for offences defined in more detail by Czech and European legislation. The aim was to identify individual sanctions resulting from the Energy Act and to compare their effectiveness with the development of earnings before taxes of selected companies. The main finding was that the performance of energy companies and penalties for offences do not evolve at the same pace. The thesis concludes by recommending an amendment to the Energy Act to modify the existing categories of offences and to increase the maximum amount of fines set at a 'fixed rate' by at least the average increase in the consumer price index.
Implementation of the Third energy package into the legal order of the Czech Republic

Implementation of the Third energy package into the legal order of the Czech Republic Summary This thesis discusses the implementation issue of the Third energy package, also known as the Third liberalization package, into the Czech national law. It consists of three regulations and two directives of the European Union, which determines the energy politics both on the European level and on the level of the member states. The first part of this thesis describes the ancestors of the Third energy package and their accomplishments or failures together with reasons for creating the next generations of liberalizing legislation. The author describes the liberalization in the form of the legal, functional and accounting unbundling separately for electricity and gas industry at the European level, and then the implementation at the level of the Czech legislation. In the next chapter it is further explained, what were the European legislator's incentives for creating the Third energy package, and what new institutes it stipulates. Thesis title: Legal regulation of the use of alternative energy resources The goal of the paper is to analyze the legal regulation of the use of alternative energy sources and to provide a summary and logical overview of this matter that is closely related to environment and climate protection. The greenhouse effect is frequent topic of current debates regarding the climate changes that lead the international communities to decision on limitation of greenhouse gases emissions by using among others renewable energy sources. The reason for my research is a long-term interest in renewable energy sources. The thesis is composed of seven chapters, each of them dealing with different aspects of promotion of the use of alternative energy sources. Chapter One is introductory and provides the overview of the research topic. Chapter Two explains the term alternative energy sources and its relation to renewable energy sources. Chapter Three is divided into two subchapters dealing with international and European aspects of the climate protection and related law. 89 Public law regulation of renewable energy sources usage in the Czech Republic Abstract This thesis is devoted to the public regulation of renewable sources usage in the Czech Republic. It is however strongly emphasizing the European component of the regulation and it gives some focus to a comparison of Czech regulation with foreign regulation, specifically German. Principles and instruments of environmental protection in the energy sector

The Diploma Thesis deals with individual principles and instruments of environmental protection in the context of energy. The work is systematically divided into three parts in order to first introduce readers to the energy field with regard to the environment, and then practically demonstrate the reason behind emphasizing application of given tools and principles. In the thesis, there is an analysis of the legislative regulation of energy on all three levels, meaning international, union and national. In conclusion, potential shortcomings are pointed out, as well as controversial topics of Energy Law including recommendations for their solution.

Energy law of the Czech Republic Abstract The diploma thesis is devoted to the Energy law of the Czech Republic and its main purpose is to analyse the regulation of enterprise in the energy sectors under public law. The thesis concentrates mostly on the regulation under the Energy act, but it also reflects relevant regulation contained in other statutes, regulations, European Union legislation or international agreements. The thesis also reflects the consequences of the stated regulation for the enterprises performing business activities in the energy sector. For this purpose, the thesis distinguishes between various entities operating on the market with (i) electricity, (ii) gas and (iii) heating. Besides it also defines what preconditions individual subjects must meet to perform the activities in energy sector and what obligations the energy law imposes on them. In this context the thesis concentrates on the instruments of legal regulation used in this field, especially the licence, the certificate of independence and the state authorization for the construction of the power stations or some gas facilities. Protection of Investments in Gas Sector: The Perspectives of Legal Relations between the European Union and the Russian Federation

The absence of a relevant legal basis between huge commercial partners such as the EU as a single entity and the Russian Federation promoted the emergence of a legal vacuum. The long term cooperation between Russia and the EU has only one bilateral agreement - the Agreement on Partnership and Cooperation signed in 1994, which is however obsolete, and does not meet the contemporary needs. The adequate legal basis for Russia-EU cooperation in the gas sector is still missing. The protection of investments in the gas sector is being realized by bilateral agreements between Russia and EU member states, soft law and general international agreements, without any specifications for those two partners. The only international instrument covering the energy relations of these two partners - Energy Charter Treaty cannot be considered as a reliable mechanism, as Russia withdrew from it more than 8 years ago. The reasons of the withdrawal and the Yukos case as an illustrative example are discussed in this paper. Legal regulation of the renewable energy resources

With the adoption of the Act on Promotion of Use of Renewable Energy Resources in 2005, the Czech Republic took a significant step forward to examine the economic field of energy in general in light of environmental and climate protection. With this act, the Czech Republic followed the example of other European Union member states in asserting the goal of reducing greenhouse gas emissions and seeking alternative energy resources in the spirit of the Kyoto Protocol obligations. The goal of this Master's thesis is to present and logically analyze the relevant legal legislation concerning renewable resources passed in the Czech law. The emphasis of this analysis of the Act No. 180/2005 Sb. on the Promotion of the Use of Renewable Energy Resources in the context of energy law, whereby the attention is placed on promotion of energy production, those in the Czech Republic represent two alternative schemes: "feed-in tariff" and "green bonus certificates." With the broad definition of renewable energy resources in the introduction, this thesis comprises a basic overview of this comprehensive legal problem. This thesis consists of five separate chapters, which are closely related.
